Art classes and events at Bundabubs Art Play Classes are so much fun!

We want to make sure everyone who participates in our classes has the best experience possible and to do that, we want to make sure you're aware of our expectations and protocol.

Bundabubs General Policies and Class Expectations

By booking into a class or event with Bundabubs, you agree to the following:

Be Safe
We take the safety of your children seriously. You acknowledge that your child has no physical, emotional, or social conditions that make it dangerous or unwise for your child to safely participate in our art classes. You will inform your child before a beach class that they must stay within the art play area until you collect them at the end. Children who leave the area may be asked to leave the class.

Be Sunsafe
You will apply sunscreen to your child and ensure they wear a hat throughout the class. These conditions must be adhered to in order for your child to take part.

Expect mess
We allow children to get as messy as they want! You will make sure your child is properly dressed for a Bundabubs class which means wearing appropriate clothing or an old shirt/apron over clothes as paint may not come out.

Respect the tools
We use a wide range of materials in our art play classes including, but not limited to: paint, glue, glitter, gems, chalk, shells, sticks, forks and other sharp objects. While we do our best to monitor every child’s use of these materials, accidents may occur from time to time due to the inherent risk in using these materials. You understand that these materials are not meant for consumption and will instruct your child not to consume any materials and to always conduct themselves in a safe manner.

Respect the space
Our sessions are held in studios, halls and school art rooms. Please be mindful that these spaces are rented by Bundabubs and as such need to be used respectfully. Running around the room is not permitted. Children are asked to be careful when moving from one station to another that they do not drip paint, or any other material onto uncovered walls, flooring, tables or chairs. Children are not permitted to leave the Maker Space or Sorrento Hall without an adult. Children are allowed to leave the room during a session to go to the bathrooms attached to the room. Children attending sessions at the Maker Space are not permitted to leave the room to go to the bathroom without parent supervision.
Children will be asked to help clean up at the end of a session.

Be Kind
Our aim is to nurture a positive learning environment where creativity and self expression are at the forefront. You and your child agree to treat all participants of Bundabubs art play classes with kindness and respect to ensure that we can hold a safe space for our students.

Adult interaction
Bundabubs art play classes do not require any adult participation. Bundabubs will indicate such time as is appropriate for photos and videos to be taken by parents and the host so as not to interrupt the flow of play. Adults who enter the art play area are asked not to comment on the children's art work or instruct them in any way about the amount or use of materials. Bundabubs outlines a set of rules at the beginning of the session and will be the only adult to enforce rules during the session. We would love for you the host and parents to enjoy watching the children have fun and know that although it may look like there are no rules, we have given very specific child friendly rules and instructions to ensure the safety of everyone in the art play space. Please respect the safe space we provide for the children to express themselves however they choose.

Photo Consent
We love sharing your child's creative genius and we may take photographs, video and/or audio ("Media") during our art play classes to post on our social media. We are the sole owner of any Media and may use the Media in any way, in our sole discretion. By giving your consent through our photography consent form you grant us permission to use your child’s image without any restriction and waive your right to inspect or approve the Media.

Permission to participate
You give your permission for your child to participate in Bundabubs Art Play Classes. You release and hold Bundabubs harmless from any and all liability that may arise in connection with Bundabubs art play classes or events.

Stay in the loop
If you choose to subscribe to the Bundabubs mailing list, we may send you news, upcoming classes, creative inspiration, products and offers by email. You can unsubscribe at any time using the link provided in our emails.

These Terms & Conditions are governed by the laws of Western Australia. You have thoroughly read, fully understand and agree to be bound by the terms of these Terms & Conditions. These Terms & Conditions will govern your child’s current and future participation in Bundabubs art play classes.

Cancellation
Once payment of a deposit or payment in full has been taken it becomes non-refundable.

Bundabubs Art Party Expectations

For every arty party to be as successful as possible, we need everyone to be on the same page.

Please read our GENERAL POLICIES as a guide of our expectations for you and your guests.

It is your responsibility to sign the Bundabubs accident waiver and release of liability form provided at the time of booking. You understand that an arty party will not go ahead if Bundabubs have not received this form no later than 2 weeks prior to the party.

Payment

Payment for an arty party can be made in full at the time of booking or a deposit of $150 can be paid at the time of booking. Should you choose to pay a deposit, the final payment of the remaining sum is due 1 weeks prior to the party. We will send you an invoice to the email address you registered with us upon booking, with how to pay for your party when payment is due.

Beach party

Host family may only arrive 20 minutes prior to party start time. During set up we request that the host and family do not interact with the play materials or set up until which time as the party is due to start. All guests are expected to depart when your party time ends. Host family and guests are not permitted to help with pack down and must vacate the area as soon as possible.

Party at host home

Bundabubs will need access to your chosen venue 1 hr 15 minutes before the scheduled start time. During set up hosts and their family will not be permitted to enter the art play area or touch the materials. Party host must inform all guests of our photo consent requirement and ask them to give their consent on our website page titled "Photography Consent" or email bundabubs@gmail.com to indicate that they do not give consent. Host must also ensure that themselves and each guest have signed the accident waiver and release of liability form and submitted it to us not later than 2 hours prior to the party for the party to go ahead.

Potion play

During our potion play parties using vinegar children can choose to wear goggles to protect their eyes. They can wear their own swimming goggles for comfort. Potion play ingredients include bicarbonate of soda, dish soap, vinegar, mica powder, glitter, dried herbs, spices, fruit, essential oils and flowers. All ingredients to be checked by host and shared with guests prior to party. Should there be any allergies to the ingredients hosts or guests should please email bundabubs@gmail.com so Bundabubs can provide an alternative.

Markets/Events/Festivals Expectations

For every community event such as a festival or market to be as successful as possible, we need everyone to be on the same page.

Please read our GENERAL POLICIES as a guide of our expectations for you and your children.

Booked Session

After booking you will need to read the email outlining the information about the session. You will click on the button to give your consent for photos/videos to be taken of your child as per the conditions outlined in our general policy above. Without this your child will not be able to participate.

It is your responsibility to arrive promptly for the start of your session and collect children afterwards at the assigned time. Children will not be released until an adult is with them who has informed us they are there.

Each participant's parent or carer will be required to sign the Bundabubs accident waiver and release of liability form at the start of the session.

Free Flow Areas

If you are attending a festival, market or community event where we have a free flow area please be aware that you must stay with your child in this area unless otherwise stated on the day.

Bundabubs Hire Agreement Summary

Booking & Payment

A quote is valid for 15 days.
A booking is only confirmed once you pay the security bond ($150) and any deposit required. This will be refunded within 7 business days after the hire period, provided all items are returned on time, clean, and undamaged.
Full Payment must clear 7- 10 days before the hire date.
Late payments not received within 72 hours prior to their event may result in automatic cancellation and loss of deposit.
Deposits are non-refundable (unless otherwise stated).
Late or missed payments may delay or cancel delivery.
You are responsible for any debt collection fees if payments are overdue.
Prices may change if Bundabubs’ costs rise before your hire date.

Security Bond

Held to cover damage, loss, late returns, or cleaning fees.
Refunded within 7 days if all items are returned on time, clean, and undamaged.
Deductions may be made for:
- Repairs or replacements
- Late fees
- Cleaning charges
- Outstanding balances

The Kit (Hired Items)

Standard hire is Friday to Monday.
You must:
- Inspect all items upon delivery/collection.
- Use and transport them safely.
- Keep them clean, dry, and secure.
- Not tamper with, repair, stick, or attach anything (e.g., tape, glue) unless approved in writing.
You are responsible for any damage or loss, including from guests or event attendees.
Failure to return items on time may incur daily hire fees until they’re returned or paid for.

Delivery, Collection, storage & Return

Delivery fees depend on distance from Duncraig.
Extra costs apply if delivery or collection is delayed or difficult.
Equipment must be returned clean, dry, and in original condition; additional cleaning fees may apply.
The Hirer must ensure secure storage of all hired items at all times. Items must not be left outdoors overnight, in wet areas, or in hot vehicles.
The Hirer is responsible for ensuring adequate space for safe transportation of Kit.
Equipment must be kept in a safe, secure, and dry location at all times. Kit must not be left in unsecured areas, in wet conditions, outside overnight or inside vehicles exposed to excessive heat.
All items in the Kit must be returned clean, dry, and in their original condition. Kit items must be free from food, drink, wax, paint, tape, glue, adhesives, decorations, and any other foreign materials.
A cleaning fee of $50 per hour applies if items are returned in an unacceptable condition. The Owner reserves the right to retain part of the bond to cover cleaning costs.

Cancellations & Amendments

Cancellations must be in writing.
If you cancel, you forfeit the deposit.
Amendment fees apply depending on booking value and timing (higher fees closer to the event).
Bookings can only be changed once and must be rebooked within 12 months.
No refunds for bad weather — you must have your own backup plan.
Bundabubs may cancel your booking for non-payment or other breaches.

Force Majeure (Uncontrollable Events) and weather

The Hirer is responsible for having a suitable wet weather back up plan in place for all outdoor events.
Bundabubs isn’t liable for delays or cancellations due to events outside their control (e.g., fire, flood, government restrictions).
No refunds or credits will be provided for cancellations due to weather.
If no new date can be agreed, your booking is treated as cancelled, and payments made are forfeited.

Default & Repossession

You’re in default if:
- You breach terms and don’t fix it within 7 days.
- You fail to pay or become insolvent.
Bundabubs may repossess the Kit without notice.
You must reimburse any costs or damages related to repossession.

Liability & Warranties

Bundabubs will use reasonable care in providing the Kit.
They’re not liable for:
- Wrong items ordered
- Damage caused by your negligence or unsafe venue
Their liability is limited to repair, replacement, or refund of the Kit.

Ownership

All items remain Bundabubs’ property at all times.
You do not own or have the option to purchase the Kit.
You are only borrowing (hiring) the items for the agreed period.

Privacy Policy

Bundabubs respects your privacy and is committed to handling your personal information carefully and responsibly.

This Privacy Policy explains what information Bundabubs may collect when you visit the Bundabubs website, make a booking or purchase, contact Bundabubs, subscribe to emails or otherwise interact with the business, and how that information may be used.

Information We Collect

Depending on how you interact with Bundabubs, we may collect information such as:

Your name
Email address
Phone number
Billing and delivery or collection information
Information relating to your booking, order or enquiry
Information you provide when registering a child for a Bundabubs class, party, workshop or event

Please only provide personal information about another person where you have permission to do so.

Communicate important information about a class, party, booking, event or purchase

Online Purchases and Payments

The Bundabubs website is hosted using Wix.

When you place an order or make a booking through the website, information necessary to process your transaction may be handled by Wix and relevant payment providers.

Bundabubs does not need to directly receive or store your complete payment card details in order to process online payments. Payment providers handle payment information according to their own terms and privacy practices.

Digital Products

When you purchase a Bundabubs digital product, your name, email address and order information may be used to provide access to your download and send information directly related to your purchase.

This may include your Paint Along Tutorial, Grown Up Guide or other files included with your purchase.

Transactional emails relating to your purchase are separate from Bundabubs marketing emails.

Email Marketing

Bundabubs may send you news, new product information, upcoming classes, offers and other marketing communications where you have consented to receive them.

Providing your email address to make a purchase, booking or enquiry does not automatically subscribe you to Bundabubs marketing emails.

You can unsubscribe from marketing communications at any time using the unsubscribe option provided in the email.

This separation is worth keeping. ACMA specifically warns businesses against automatically adding someone to a marketing list simply because they made a one-off purchase or enquiry. Commercial emails generally require consent, sender identification and a functional unsubscribe facility. (ACMA)

Cookies and Website Analytics

The Bundabubs website may use cookies and similar technologies to help the website function, understand how visitors use the site and improve the online experience.

Third-party services used through the website may also use cookies or similar technologies in accordance with their own privacy practices.

You can control or restrict cookies through your browser settings, although doing so may affect how some parts of the website function.

Sharing Your Information

Bundabubs does not sell your personal information.

Your information may be shared with service providers where reasonably necessary to operate the business, provide your purchase or booking, or maintain the website.

Bundabubs may also disclose information where required or authorised by law.

Children's Information

As Bundabubs provides children's art classes, parties and creative experiences, parents and caregivers may provide information relating to their children when making a booking.

Bundabubs only asks for information reasonably required to organise and safely provide the relevant activity or service.

Parents and caregivers should provide children's information rather than asking children to submit personal information directly through the Bundabubs website.

Photographs and Creative Work

Photographs taken during Bundabubs classes, parties or events are managed in accordance with the relevant photography or media consent provided for that activity.

Bundabubs will not treat purchasing a product, attending a session or joining the mailing list as automatic consent for photographs of a child to be used for marketing purposes.

If you voluntarily send Bundabubs a photograph, testimonial, review or image of artwork, Bundabubs will ask for appropriate permission before using identifiable photographs for promotional purposes where required.

Storage and Security

Bundabubs takes reasonable steps to protect personal information from misuse, loss and unauthorised access, modification or disclosure.

Information may be stored using the systems and service providers Bundabubs uses to operate the business, including Wix and other business software.

No method of electronic storage or transmission is completely secure, so absolute security cannot be guaranteed.

Accessing or Correcting Your Information

This Privacy Policy may be updated from time to time to reflect changes to Bundabubs services, website, products or business practices.

The most recent version will be published on the Bundabubs website with the date it was last updated.

One change I'd make elsewhere on your website

I would now remove your existing wording along the lines of:

“By providing your email address, you agree to be added onto Bundabubs' email mailing list.”

Your checkout/booking email should be used to fulfil the customer's order or booking. Marketing should have its own optional consent, such as:

That's a cleaner setup and aligns with ACMA's current recommendation to obtain clear express consent for marketing. (ACMA)

I would also keep promotional content out of the automated email containing the purchased digital download unless the recipient has marketing consent. ACMA's current guidance says an otherwise factual/service email can become a commercial message if promotional material or sales links are added to it. (ACMA)

For Bundabubs, that means your automated “Your Paint Along is ready!” email can safely concentrate on their purchase, download, setup instructions and customer support rather than adding “Shop our other kits” at the bottom. That gives you a nice clean distinction between transactional emails and marketing emails.
